The Law and the Penelty

United States Founding Fathers and Founding Americans

The word 'homosexual' didn't exist at the time of the Founding Fathers. It apparently appeared around 1892. The act "1 : of, relating to, or characterized by a tendency to direct sexual desire toward another of the same sex or 2 : of, relating to, or involving sexual intercourse between persons of the same sex" was so abhorant to everyone in Founding times that it was little talked about or defined. The three words the founding generation did have illustrate this: "SODOMY, n. A crime against nature". "PEDERASTY, n. Sodomy; the crime against nature." "BUGGERY, n. The unnatural and detestable crime of carnal intercourse of man or woman with a beast; or of human beings unnaturally with each other. Sodomy." - United States Founding Father, Revolutionary War Soldier, Legislator, Judge, Noah Webster, NOAH WEBSTER's FIRST EDITION OF "AN AMERICAN DICTIONARY OF THE ENGLISH LANGUAGE", 1828. Notice that they agreed with the bible that the act was "unnatural" and "detestable" .

"At a General Court Martial whereof Colo. Tupper was President (10th March 1778), Lieut. Enslin of Colo. Malcom¡¯s Regiment [was] tried for attempting to commit sodomy, with John Monhort a soldier ... [he was] found guilty of the charges exhibited against him, being breaches of 5th. Article 18th. Section of the Articles of War and [we] do sentence him to be dismiss¡¯d [from] the service with infamy [public disgrace]. His Excellency the Commander in Chief approves the sentence and with abhorrence and detestation of such infamous crimes orders Lieut. "The crime not to be named [sodomy], I pass in a total silence." - United States Founding Father, Signer of the Declaration of Independence, Signer of the Constitution, Original US Supreme Court Justice, James Wilson, The Works of James Wilson (Cambridge: Belknap Press of Harvard University Press, 1967), Vol. II, p. 656. James Wilson was so disgusted with homosexuality that in his legal works he only wrote the one sentence above on the subject.

In Virginia, "dismemberment¡± of the offensive organ was the penalty for homosexuality. - Thomas Jefferson, "Notes on the State of Virginia", (Philadelphia: Matthew Carey, 1794), p. 211, Query XIV.

Thomas Jefferson himself authored a bill to penalize sodomy by castration. - Thomas Jefferson, "Writings of Thomas Jefferson", Albert Ellery Bergh, editor (Washington D. In Connecticut "death" was the penalty for homosexuality. - "The Public Statute Law of the State of Connecticut", (Hartford: Hudson and Goodwin, 1808), Book I, p. 295, Title LXVI, Chap. I, ¡ì 2

In South Carolina, 'death and the forfeiture of possessions', was the penalty for homosexuality. - "Alphabetical Digest of the Public Statute Laws of South Carolina", (Charleston: John Hoff, 1814), Vol. I, p. 99, Title 28

In Vermont, "death" was the penalty for homosexuality. - "Statutes of the State of Vermont", (Bennington, 1791), p. 74, March 8, 1787

In Georgia, 'life in prison at hard labor' was the penalty for homosexuality. - "A Digest of the Laws of the State of Georgia (Milledgeville: Grantland and Orme, 1822), p. 350, Section XXXV

In Maine, 'solitary confinement for up to one year and imprisonment at hard labor for up to ten years' was the penalty for homosexuality. - "Laws of the State of Maine", (Hallowell: Goodale, Glazier and Company, 1822), p. 58, Chapter V, Febrary 19, 1821

In Pennsylvania, 'imprisonment at hard labor' was the penalty for homosexuality. - "Laws of the Commonwealth of Pennsylvania", (Philadelphia: John Bioren, 1810), Vol. I, p. 113, Chapter CCXXXVI, Section VII

Notes on the Law (Reason and Experience)

Homosexuality is vile, unnatural and shameful: "For this reason God gave them up to vile passions. For even their women exchanged the natural use for what is against nature. Likewise also the men, leaving the natural use of the woman, burned in their lust for one another, men with men committing what is shameful, and receiving in themselves the penalty of their error which was due." - God, Bible Romans 1:26-27

Homosexuality is like a deadly contagious disease that becomes an uncontrolable epidemic: "Now before they lay down, the men of the city, the men of Sodom, both old and young, all the people from every quarter, surrounded the house. And they called to Lot and said to him, "Where are the men who came to you tonight? Bring them out to us that we may know them carnally." ... So they pressed hard against the man Lot, and came near to break down the door. But the men reached out their hands and pulled Lot into the house with them, and shut the door. And they struck the men who were at the doorway of the house with blindness, both small and great, so that they became weary trying to find the door." - God, Bible Genesis 19:4-11

Homosexuality can be forgiven: "Do you not know that the unrighteous will not inherit the kingdom of God? Do not be deceived. Neither fornicators, nor idolaters, nor adulterers, nor homosexuals, nor sodomites, nor thieves, nor coveteous, nor drunkards, nor revilers, nor extortioners will inherit the kingdom of God. And such were some of you. But you were washed, but you were sanctified, but you were justified in the name of the Lord Jesus and by the Spirit of our God." - God, Bible I Corinthians 6:9-11
